What Is Alternative Dispute Resolution?
ADR are a few select options that allow for a private, less adversarial approach to solving complex issues. In a divorce or in any other family law conflict, ADR methods offer a way to build bridges while solving problems.
There are two main ADR methods that we help our clients with: mediation and binding arbitration. Both of these options include a guided negotiation where all issues within your conflict are discussed at length. At the end, the mediator or arbitrator will offer a solution, be that a property division agreement or child custody parenting plan that works and causes less friction between parents who will have to co-parent.
However, the key difference between mediation and arbitration is that end point. Under mediation, both sides must agree then to accept the mediator’s suggestion, or else the matter goes back to court. Under arbitration, both sides agree to abide by the arbitrator’s findings, which is why it is usually called “binding arbitration.”

Aside from the more peaceful approach to conflict, ADR is private, meaning none of the discussions there go public, whereas court cases are a part of public record. In the vast majority of cases, you can also get to mediation or arbitration faster than you can go before a judge in mediation. Because less time is spent in court and less time is spent fighting, typically, ADR is a massive cost savings.
ADR often works for high-conflict divorce problems, including high-asset divorces, property division, alimony, custody, parenting plans and child support. These issues tend to be highly divisive, but with ADR, you can leave the proceedings with far less pain and long-term emotional challenges.
