The initial phases of the divorce process, at least where child custody is concerned, focus on crafting a workable parenting plan, which describes all the aspects of the custody arrangement. Having a parenting plan is required. You and your ex will have to define:
- A physical custody schedule: Who lives with the child during what weeks, what holidays and a regular visitation schedule, if one parent is noncustodial.
- Legal custody: You will both share in the decision-making responsibility for the child/children.
- Emergent situations: No plan is perfect, and occasionally last-minute schedule changes must happen. It is best to define these processes early.
Once a parenting plan is set, it can only be modified through the official divorce decree modifications process. Any decision, from creation to modification, will always be resolved by looking into the best interests of the child. That will be the court’s concern, not what works best for the parents.
